§ 1. General provisions

1. The Organiser of the Best Brands 2024 gala is Group One Spółka Akcyjna with its registered office in Warsaw, al. Jerozolimskie 134, 02-305 Warsaw, entered in the register of entrepreneurs of the National Court Register under no. 0000489566, whose registry files are maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Economic Division of the National Court Register, with the NIP no. 5272706395, with the share capital of PLN 2,651,000.00 (hereinafter referred to as the “Organiser”).
2. These Rules and Regulations of the Best Brands 2024 gala (“Rules and Regulations”) have been developed by the Organiser and are addressed to everyone present at the site during the gala. Everyone present at the site during the gala shall comply with the provisions hereof.
3. Unless the content of these Rules and Regulations stipulates explicitly otherwise, the following capitalised terms shall have the following meanings: 1) Gala – the ceremonious Best Brands Awards 2024 gala organised by the Organiser, which will be held in Zamek Ujazdowski in Warsaw on 6 June 2024. 2) Participant – any person who has registered their participation in the Gala based on the Invitation. 3) Invitation – the invitation authorising its addressee to register for and participate in the Gala, received from the Organiser by electronic means.
4. These Rules and Regulations are provided to the persons invited to the Gala prior to such persons’ registration of their participation in the Gala.
5. Registration for the Gala shall be tantamount to the acceptance of these Rules and Regulations and commitment to comply with the provisions thereof.

§ 2. Terms and conditions of participation in the Gala

1. The conditions for participating in the Gala shall include:
   1. Registering the Gala Participants on the registration website and receipt of the confirmation of the registration in the form of an Invitation to the Gala.
2. The registration requires provision of the Participant’s personal data, i.e. first name, last name, email address, business name, numer of phone.
3. During the Gala, the Organiser or the third parties authorised by the Organiser may carry out photo sessions and film the Gala for the purpose of mass media broadcasting (television, radio, Internet, press) or for the purpose of documentation, promotion, advertising of the Organiser and other persons indicated by the Organiser (the Media Partner, Sponsor, Partner, or Co-Organiser of the Gala).
4. Participation in the Gala shall be tantamount to the acknowledgement that both the Organiser and the third parties authorised by the Organiser have the right to record, reproduce, use and/or disseminate the recording of the image/voice/utterances (which shall include, among others, audiovisual recording, image recording using any photographic or reprographic techniques, and voice recording in the form of magnetic or digital recording) of each of the Participants in all promotional and marketing materials without limitation to time and place, and consent thereto.
5. Participation in the Gala shall be tantamount to the acknowledgement of and consent to the possibility of disseminating the photographs, videos or recordings made during the Gala via any medium and in any form, including through public performance, exhibition, display, play, broadcasting and retransmission as well as public sharing of the recording such that anyone could access it at the place and time at their discretion and without limitations to place, time, number of transmissions or publications, both in whole and in parts. Specifically, they may be published on the Gala’s website, social media, or another website and used in promotional materials as well as disseminated in a video or audio form to this end.
6. The consent to the recording and dissemination of the Participant’s image/voice/utterances for the purposes specified herein shall be given without remuneration.
7. The Participants shall comply with the provisions of the rules and regulations applicable at the site where the Gala is held, including in particular safety rules arising from public order regulations and fire regulations.
8. The Organiser may refuse entry to the Gala to the persons whose behaviour implies that they are under the influence of alcohol or narcotic drugs or pose any other risk to the public order or security of the staff or other Participants in the Gala.
9. The Organiser shall have the right to refuse entry to persons having dangerous materials (e.g. weapon), materials which might interrupt the event (e.g. ones emitting noise, impeding movement) on them or dressed inappropriately (and to ask them to leave the venue of the Gala).
10. During the Gala, the Participant shall comply with any instructions concerned with safety of the Gala Participants.
11. The Participant acknowledges that where the Organiser finds that the Participant breaches the provisions hereof and persistently interrupts the Gala, the Organiser shall have the right to refuse the Participant the right to participate in the Gala and to demand that the Participant leave the venue of the Gala or the site where the Gala is held.
12. The Organizer agrees to the participation of the Participant during the Gala on the basis of a properly completed registration.
13. The organizer has the right to refuse to participate in the Gala without giving reasons.

§ 3. Personal data

1. The Controller of the data processed as part of the Best Brands Awards is Group One S.A. with its registered office in Warsaw, at al. Jerozolimskie 134, 02-305 Warsaw, entered in the register of entrepreneurs of the National Court Register under no. 0000489566, whose registry files are maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Economic Division of the National Court Register, with the NIP no. 5272706395, with the share capital of PLN 2,651,000.00.

3. The purpose of and grounds for the processing of personal data being full name, telephone number, email address shall be processed for the purpose of organising Best Brands Awards, including registering for and enabling participation in the event (Article 6(1)(b) of the GDPR). The consent to the processing of personal data may be withdrawn by sending an email to the following address: iod@groupone.com.pl
4. The aforementioned personal data of the Participants shall be processed also for the purposes of the legitimate interests pursued by the Controller (Article 6(1)(f) of the GDPR). They shall have the right to object to the processing of data for these purposes by sending an email to the following address: iod@groupone.com.pl
5. The data may be made available also to other entities being part of the Group One group to the extent required for the performance of a contract or pursuit of a legitimate interest of the group of entities (in particular for administrative purposes).
6. The Participants’ personal data may be transferred to Processors on the Controller’s commission, among others third parties that support the Controller (IT support), and these parties shall process the data exclusively based on contracts concluded with the Controller and in accordance with its instructions. Data may also be shared with our Partners involved in the Best Brands Gala for analysis, summaries and internal event reports. Our Partners are: Polsat Media Biuro Reklamy Sp. k. with its registered office in Warsaw nr KRS: 00004675479, Polsat Media Biuro Reklamy Sp. z o.o. with its registered office in Warsaw, nr KRS: 0000451278, Grupa Interia.pl sp. z o.o. with its registered office in Warsaw, nr KRS: 0000416593, Ringier Axel Springer Polska sp. z o.o. with its registered office in Warsaw, nr KRS: 0000420780, GfK Polonia sp. z o.o. with its registered office in Warsaw, nr KRS: 0000163116, and entities belonging to one capital group together with the entity mentioned above.
7. We shall keep personal data in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the personal data are collected and processed, with the withdrawal of the consent or objection to the processing taken into account.
8. Data subjects shall have the right to: 1) access their data and receive a copy thereof 2) rectify (correct) their personal data; 3) restrict the processing of personal data; 4) erase the personal data; 5) lodge a complaint with the President of PDPO (to the address of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw)
9. The provision of the aforementioned personal data by the Participants shall be voluntary but necessary for them to participate in the Best Brands Awards 2024.

§ 4. Final provisions

1. To the extent permitted by law, the Organiser reserves the right to amend these Rules and Regulations, provided that this will not infringe the rights vested in the Participants.

3. The Customers and Participants being Consumers may resolve disputes by electronic means via the EU ODR platform, which enables lodging complaints and asserting claims concerned with the contracts concluded by them – the platform is available at: http://ec.europa.eu/consumers/odr/. The Organiser’s email address is office@sar.org.pl
4. Consumers may also use the assistance of the Consumer Ombudsman or non-governmental organisations acting for consumers. More information can be found on the webpages of the Office of Competition and Consumer Protection (www.uokik.gov.pl).
5. Any and all disputes which may arise from the application of these Rules and Regulations and which cannot be resolved amicably shall be resolved by the court competent for the registered office of the Organiser, save when a party to the dispute is a person acting as a consumer.
